This rental agreement is entered into between the owner(s) of vacation villa Villa Rais, located in Grote Berg, Curaçao, hereinafter referred to as "Landlord", and the undersigned, hereinafter referred to as "Tenant", according to the details specified in the confirmed booking.
Article 1: Rental Period
1.1 The rental period is as indicated in the booking.
1.2 Check-in is from 16:00 and will be determined in consultation, if possible based on flight arrivals.
1.3 Check-out is until 11:00 and will be determined in consultation, if possible based on flight departures.
1.4 During the rental period, the Tenant must provide access to the villa, pool, and garden for any necessary maintenance, pool maintenance, and cleaning work. This access is granted after prior consultation, with the aim of ensuring minimal disruption to the Tenant's stay. The Landlord ensures that such work is carried out with respect for the Tenant's privacy and comfort.
Article 2: Damage & Deposit
2.1 Any damage to the villa or furnishings during the rental period must be reported immediately by the Tenant to the Landlord. The Landlord reserves the right to deduct damage costs from the deposit, or to charge them separately.
2.2 Normal electricity consumption, namely 15 kWh per room (based on 2 persons per room) per day, is included in the rental price. Additional consumption will be charged at € 0.55 per kWh and deducted from the deposit.
2.3 If upon the Tenant's departure it appears that excessive cleaning is required beyond normal wear and tear, the Landlord reserves the right to deduct the extra cleaning costs from the deposit.
2.4 If the Tenant uses the villa with more persons than the number of guests specified at booking, the Landlord reserves the right to charge additional costs.
2.5 The deposit will be refunded one week after departure, after any deductions.
Article 3: Rules of Conduct
3.1 As the villa is located in a quiet residential area, the Tenant must be considerate of neighbors by limiting noise disturbance, especially between 22:00 and 6:00.
3.2 Smoking is not allowed inside the villa.
3.3 Pets are not allowed without prior written approval from the Landlord.
3.4 The number of guests may not exceed the number specified in the booking without the Landlord's permission.
3.5 The pool must be used responsibly. Children under 16 may only use the pool under adult supervision.
3.6 The Tenant commits to ensuring the security of the villa at all times. This means that when leaving the villa, the Tenant ensures it is properly locked and that the security system (alarm) is activated. It is the Tenant's responsibility to ensure that all doors and windows are closed and that the alarm is correctly activated to safeguard the villa and its contents. Failure to comply with this clause may result in the Tenant's liability for any losses or damages resulting from burglary or theft.
3.7 The Tenant agrees to leave the villa tidy and in a reasonable state of cleanliness at the end of the rental period. This means that all used spaces are free of waste, kitchen appliances are clean, and all items are returned to their original place.
Article 4: Cancellation Terms
4.1 If the tenant wishes to cancel the booking for any reason, the tenant must always confirm this by email to the landlord (even if this has already been communicated to the landlord by telephone, for example). The landlord charges the following amounts, depending on the date of written cancellation by the tenant:
- cancellation more than 3 months before the start of the rental period: free of charge
- cancellation between the 90th and 60th day before the start of the rental period: 25% of the rental price
- cancellation between the 59th and 30th day before the start of the rental period: 50% of the rental price
- cancellation less than 30 days before the start of the rental period: 100% of the rental price
4.2 If the tenant only communicates on the start date or during the rental period that they will not (or no longer) use the rented property, or does not arrive at Villa Rais (no-show), they remain liable for the full rental price.
Article 5: Liability
5.1 The Landlord is not liable for personal injury, loss of or damage to personal property of the Tenant that occurs during the rental period.
